1. Introduction

 

1.1. In these Terms of Services, "we" and "us" mean GGList, and "you" means you, the customer, buyer or sellers. These Service Terms are the contract between you and us for goods and services along with your Order Confirmation. There shall be no other Service Words.

 

1.2. The Site maintains whatever authority is needed to change, adjust, include, or expel bits of these Terms of Services whenever with no earlier warning. Changes will be successful when posted on the Site with no other notification given. If it's not too much trouble, check these Terms of Services generally for refreshes. You proceed with the Site's utilisation following the presenting of changes on Terms of Services of utilisation establishes your acknowledgement of those changes.

 

 2. Account Terms

To access and use the Services, you must register for a GGList account ("Account") by providing your full legal name, current address, phone number, a valid email address, and any other information indicated as required. GGList may reject your application for an Account, or cancel an existing Account, for any reason, at our sole discretion.

  1. It would help if you were the older of: (i) 18 years, or (ii) at least the age of majority in the jurisdiction where you reside and how you use the Services to open an Account.

  2. You confirm that you are receiving Services provided by GGList to carry on business activity and personal, household or family purposes.

  3. You acknowledge that GGList will use the email address you provide on opening an Account or as updated by you from time to time as the primary method for communication with you.

  4. You are responsible for keeping your password secure. GGList cannot and will not be liable for any loss or damage from your failure to maintain your Account and password's security.

  5. You are responsible for all activity and content such as photos, images, videos, graphics, written content, audio files, code, information, or data uploaded, collected, generated, stored, displayed, distributed, transmitted or exhibited on or in connection with your Account ("Materials").

 

 

3. General Conditions

 

You agree that your listing, posting and Information :

  1. Shall "not be fraudulent, misrepresent, mislead or pertain to the sale of any illegal, counterfeit, stolen goods and services

  2. Shall not pertain to good services of which you are not the lawful owner, or you do not have the authority or consent to 'list' what does not belong to you or do not have the authority.

  3. Shall not infringe any intellectual property, trade secret, or other proprietary right or rights of publicity or privacy of any third party.

  4. Shall not consist of material that is an expression of bigotry, racism, or hatred based on age, gender, race, religion, caste, class, lifestyle preference, nationality, and is like being derogatory slanderous to any third party.

  5. Shall not be obscene, contain pornography, or contain "indecent representation of women" within the meaning of Women's Indecent Representation (Prohibition).

  6. Shall not distribute or contain spam, multiple / chain letters, or pyramid schemes in any of its forms.

  7. Shall not distribute viruses or any other technologies that may harm GGList or the interests or property of GGList users or impose an unreasonable load on the infrastructure or interfere with the proper working of GGList

  8. Shall not be placed in the wrong category or an incorrect area of the site.

  9. Shall not be placed in any other GGList site except on the site related to the city you located.

  10. Shall not list or post or pertain to prohibited or restricted information under the Republic of India's laws. Such listing, posting, or information shall not violate GGList's Listing Policy.

  11. You consent to receive communications by email, call or by such other communication mode, electronic or otherwise related to the services provided through the website.

 

4. GGList Rights

 

  1. We reserve the right to modify or terminate the service for any reason without notice at any time.

  2. We reserve the right to refuse service to anyone for any reason at any time.

  3. We may, but do not have any obligation to delete, illegal, offensive, threatening, disgusting, diamond, pornographic, obscene, or otherwise unacceptable ad contents that we decide are in our sole discretion or violation of any party's intellectual property or those Terms of Service.

  4. Verbal or written abuse of any kind (including threats of abuse or retribution) of any GGList customer, GGList employee, member, or officer will result in immediate account termination.

  5. GGList does not pre-screen Ads content, and it is in their sole discretion to refuse or remove any posted content available via the service.

  6. We reserve the right to provide our services to your competitors and make no promise of exclusivity in any particular market segment. You further acknowledge and agree that GGList employees and contractors may also be GGList customers/instructors and that they may compete with you. However, they may not use your confidential information in doing so.

  7. In the event of a dispute regarding Account ownership, we reserve the right to request documentation to determine or confirm account ownership. Documentation may include but is not limited to a scanned copy of your business license, government-issued photo ID, the last four digits of the credit card on file, etc.

  8. GGList retains the right to determine, in our sole judgment, rightful account ownership and transfer an account to the rightful owner. If we cannot reasonably determine the rightful Account owner, GGList reserves the right to temporarily disable an Account until resolution has been determined between the disputing parties.

5. Intellectual Property and Data Processing

 

In operating our Platform, we need to make it clear who owns what and who's responsible for what. You are trusting us with your content and consistent with GGList genuine belief in transparency. We want to make it simple for You to know precisely what You are getting into when You join the GGList community.

 

A. GGList Content: Content on the Platform, including all information, software, technology, data, logos, marks, designs, text, graphics, pictures, audio and video files, other data or copyrightable materials or content, and their selection and arrangement, is referred to herein as "GGList Content", and is and remains the sole property of GGList. GGList Content, including our trademarks, may not be modified by You in any way unless we give permission.

 

B. Your Content: Content that You upload to the Platform is and remains Your Content. GGList does not claim any intellectual property rights over the materials. You upload to the GGList Platform by Your use of our services. By uploading your content to the GGList Platform, You agree that:

 

  1. GGList may review Your Content for any reason, including compliance with our Code of Conduct and prohibited content requirements, but GGList has no obligation to review anything you upload.

  2. You are uploading Your Content to the GGList Platform at Your direction, and that GGList does not in any way certify or provide approval or permission before You upload Your Content.

  3. GGList may display Your Content to other users (e.g. Your buyers) via the GGList Platform.

  4. You agree that by uploading Your Content to Our Platform, you can store Your Content.

  5. You agree to provide GGList with all necessary licenses, including a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use (e.g., to display or transmit) Your Content in furtherance of the GGList Services (In other words, because You own Your Content, You have to permit Us to show it, or to use it for internal operational purposes, like storing it on Our servers)

  6. You are responsible for and own, or have the rights to use, all of Your Content.

 

C. Content Free of Infringement of Any Third Party Rights

 

  1. You agree that Your Content does not infringe upon anyone else's intellectual property rights and that you have secured or obtained or received all necessary rights and permissions, as necessary, from any third parties who may own the Content.

  2. In plain language, this means that if you're using someone else's work (including videos, text, charts, powerpoints, etc.) in your Content, you've gotten the content owner's permission to use it. You wouldn't want anyone selling any of Your Content without Your consent. If You are going to use something that You didn't create, make sure You can demonstrate that You have the right to use it before Making it a part of Your Content.

 

D. Data Processing Agreement

 

Creators are responsible for protecting all personal information they provide or receive from GGList connected with GGList Services' use. The GGList Data Processing Agreement ("DPA") forms part of this Agreement and sets out GGList and Creator's obligations concerning personal information processing. Creators agree to abide by the DPA when, and to the extent, Data Protection Laws apply to a Creator's use of GGList Services to process buyer and seller Data or Creator Data (as these terms defined in the DPA).

 

6. Fees and Services

 

Using GGList is generally free, but we sometimes charge a fee for certain services. If the service you use incurs a payment, you'll be able to review and accept terms that will be disclosed when you Ads your ad. Our fees are quoted based on the operated country currency, and we may change them from time to time. We'll notify you of changes to our fee policy by posting such changes on GGList. We may choose to change our fees for promotional events or new services temporarily; these changes are effective when we announce the promotional event or new service.

 

You are responsible for paying the GGList fees when they're due. If you don't, without prejudice to any other right or remedy we may be entitled to under these Terms of Use or by law, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.

 

You acknowledge that your ads may be deleted from GGList if we believe these Terms of Use, including our Posting Rules, are breached, either directly or indirectly. If you have paid for an ad already, you may get a refund.

 

Modifications to the Service and Prices

 

  1. Prices for using the Services are subject to change upon 30 days notice from GGList. Such information may be provided at any time by posting the GGList Site (GGList.com) changes or the administration menu of your GGList Store via an announcement.

  2. GGList reserves the right at any time and time to modify or discontinue the Services (or any part thereof) with or without notice.

  3. GGList shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

 

Display and placement of user ads

 

We strive to create a community where users can find what they are looking for. Therefore, the appearance or placement of ads in search and browse results will depend on a variety of factors, including, but not limited to:

 

  • users' location and search query/category selected;

  • adverts' category, content, location and date published; and

  • if the ad has a paid-for promotion

 

7. Mobile Devices Terms

 

Besides, to the applicable Mobile Privacy and Legal Notice (MPN) and End User Licensing Agreement, if GGList Services are accessible from a mobile device using a GGList Mobile Application ("Application"), the following provisions ("User Terms") apply. You comply with these Terms of Use when you use the Application.

 

Application Use. GGList gives you the right, just for your personal use, to use the application. When using the application, you must abide by all relevant laws and contractual terms and conditions (e.g. your wireless data service agreement). No same feature may be present on the www.gglist.net website in the Application. You are solely responsible for any harm or loss of data resulting from downloading or using the Application and for the downloading and use of the Application at your discretion and your own risk.

 

Intellectual Property - Applications. GGList is the owner of all titles and interests in and to its Applications or is the licensee thereof, including all rights under, including any applications, renewal, extension and restoration of patent, copyright, trade secrecy, trademark, or other proprietary rights. You will not modify, change, translate, prepare, reverse engineer, source code, re-assemble, disassemble, or otherwise attempt to retrieve source code from any Application.  And you are not going to delete, obscure, or alter GGList copyright notices, marks or other proprietary notifications appended, contained in or accessed together with GGList applications.

 

8. Cancellation and Termination

 

  1. You may cancel your Account and terminate the Terms of Service at any time by contacting GGList Support and then following the specific instructions indicated to you in GGList’s response.

  2. Upon termination of the Services by either party for any reason:

  1. GGList will cease providing you with the Services, and you will no longer be able to access your Account;

  2. Unless otherwise provided in terms of Service, you will not be entitled to any refunds of any Fees, pro-rata or otherwise;

  3. Any outstanding balance owed to GGList for your use of the Services through the effective date of such termination will immediately become due and payable in full; and

  4. If, at the date of the Service’s termination, any outstanding Fees owed by you, you will receive one final invoice via email. Once that invoice has paid in full, you will not charge again.

  5. We reserve the right to modify or terminate the GGList Service, the Terms of Service and your Account for any reason, without notice at any time. Termination of the Terms of Service shall be without prejudice to any rights or obligations that arose before the termination date.

  6. Fraud: Without limiting any other remedies, GGList may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity connected with the use of the Services.

9. Disclaimers

 

Our Platform may be down, either for planned maintenance or because something goes down with the Site. It may happen that one of our instructors is making misleading statements in their course. It may also happen that we encounter security issues. These are just examples. You accept that you will not have any recourse against us in any of these types of cases where things don't work outright.
